Can't remove orphaned DC, NTDS properties grayed out

i have orphaned domain controller i'm trying remove ad. when try deleting it says "access denied". protection accidental deletion not checked. of options in dc's properties under general tab if go ntds settings of options there grayed out, such "global catalog"(checked), , "protect object accidental deletion" (not checked), permissions under security tab grayed out. domain/enterprise admin. 

the current dc's 2008r2 orphaned dc 2003, functional level 2003.

DFSR RPC replication errors 5014 1726 with large files over VPN
